Raw Sugar Rewards Program Terms and Conditions (Rewards Terms)

These Rewards Terms are effective as of August 1, 2022 and may be added to or amended from time to time at the discretion of Raw Sugar, LLC (RAW). These Terms and Conditions apply to your access to, and participation in, the Raw Sugar Rewards Program (Rewards Program). These Terms and Conditions do not alter in any way the Website terms or conditions or the terms and conditions of any other agreement you may have with Raw Sugar for other products or services.

The Raw Sugar Rewards Program (Rewards Program) is only open to customers of www.rawsugarliving.com with a registered account who are 18 years of age or older at the time of registration and are residents of the United States.

Membership in the Rewards Program and its benefits are offered at the absolute discretion of RAW. RAW may, at any time and from time to time, terminate, change, limit, modify or cancel Rewards or any rules, regulations, benefits, or conditions of participation by posting the modified rules on this page. Your continued participation in the Rewards Program after such posting will constitute your acceptance of the Rewards Terms as amended. By enrolling in the Rewards Program, you hereby agree to these Rewards Terms and warrant that you meet the entry and eligibility requirements.

WHERE TO ENROLL, EARN AND REDEEM PROGRAM REWARDS
Points earned in the Rewards Program (Rewards Points) may be redeemed only for purchases made via www.rawsugarliving.com (Qualifying Purchases). Purchases at third-party retailers, e-tailers, or anywhere else throughout the world are not Qualifying Purchases and are not eligible for the Rewards Program.

You are automatically enrolled in the Raw Sugar Rewards Program when you create an account on our website. To enroll, you must provide your full name, email address. Individuals only may apply, not corporations or other entities. Your enrollment will be confirmed with a welcome message sent to the email address provided, which will include further enrollment information and requirements. Offers from RAW through the Rewards Program (Reward Offers) are based on dollars spent on Qualifying Purchases or other qualifying behaviors. Additional terms may apply to Reward Offers.

You'll receive: 

• ONE Rewards Point per each (USD) dollar spent* in Tier 1, the “Avocado Ace” Tier. After spending more than $200 USD in the same 12-month period, you will earn TWO Rewards points per each (USD) dollar spent* and will be in the “Pineapple Pro” Tier. If more than $400 (USD) is spent within a consecutive 12-month period, you’ll earn THREE Rewards per (USD) dollar spent* and then move up to the “Lemon Lover” Tier. The program will be a rolling 12-month calendar, and your Tier status will reset every 12 months based on your yearly spend. *Points are earned for product purchases only—excludes taxes and shipping.
• 50 Reward Points for Creating an Account.
• Bonus Point Offers throughout the year.
• Annual Birthday Reward—Save 10% off your next order after your birthday with a unique discount code (valid for 60 days) in Tiers 1 and 2. If your birthday falls and you’re in Tier 3, you’ll receive a 15% birthday code
• Leave a review and earn 50 points per product (one review per product), but if you want to leave a photo review that is an additional 50 points, along with a video review for another 50 points. A possible total of 150 points per product per Rewards Account Member
• You can also follow activated social channels available in the Rewards Dashboard for 5 points each (limited to one time per channel).
• Reward Offers are personal in nature, may have a limited timeframe to used, and cannot be re-used, transferred, refunded, or redeemed for cash (except where required by law). Rewards Points will expire 24 months from earning. Rewards Offers are not valid for use towards sales tax or shipping charges nor can they be used in conjunction with any other offer.
• Rewards Points cannot be combined with cash or with another Rewards Program member's Points, or discount codes. RAW reserves the right to limit the quantities of Reward Offers that may be used by a single member in a given time period.  Reward Points can only be used by the recipient. If you return a purchase for which you received Rewards Points, then then such points will be deducted based on the dollar value of the return. RAW may correct errors in relation to the issue of s Rewards Points or adjust for reversed transactions at any time, even if it would put your membership account into a negative balance.

RAW may offer limited–time Reward Offers or may make promotional offers selectively available to members, based on purchase activity, geographic location, program participation or other factors in RAW’s absolute discretion.

From time to time, RAW may also provide Reward Program members with an opportunity to earn additional Reward Points or Reward Offers through participation in site activities, features or by uploading user content in social media. In an effort to be transparent with our Reward Program members and the public at large, we remind you that whenever you earn Reward Points, receive products or other incentives for participation, you must use appropriate words of disclosure, such as "Points Earned", "Free Sample Received" or similar words to indicate what you received value for from RAW.

RAW reserves the right, without limitation, to terminate, change, limit, modify or cancel any of the above means of earning Rewards Points or your membership in the Reward Program, with or without notice.

Unless otherwise stated, members will be able to check their Reward Points balance by logging on to their account on www.rawsugarliving.com

PRIVACY
Your privacy is important to us. Enrollment information collected in relation to the Rewards Program is subject to RAW’s Privacy Policy.

ELIGIBILITY
Only one Rewards Program account may be associated with a single email address and each individual may only register a single email address. In the event of a dispute over ownership of Rewards Program membership account, the registration will be declared to have been made by the authorized account holder of the email address submitted at the time of enrollment. For purposes of these Rewards Terms, the "authorized account holder" is the natural person who is assigned to the submitted email address by an internet provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.

By enrolling in Rewards Program, you agree to provide true, accurate, current and complete information about yourself and maintain and promptly update the information to keep it true, accurate, current and complete. If you provide any data that is untrue, inaccurate, not current, or incomplete, or if RAW, in its sole discretion, suspects that your registration data is untrue, inaccurate, or incomplete or that you are in any way abusing your membership of the Rewards Program, RAW reserves the right to suspend, terminate or refuse your participation.

COMMUNICATIONS AND REVIEWING YOUR ACCOUNT INFORMATION
As a member, you will periodically receive emails from RAWs, and you consent to receive emails from RAW or emails sent on RAW’s behalf. You may opt–out of the marketing emails at any time, but operational emails will still be sent to you as they relate to your membership of the Rewards Program. Examples of these are: the welcome email, a Reward Program confirmation email, or other communications that help us ensure that your account is monitored.

GENERAL PROGRAM CONDITIONS AND EXCLUSIONS
Rewards Points are entirely at the discretion of RAW, have no cash value and have no purpose or use other than in exchange for benefits, products or services offered by RAW through the Rewards Program.

Rewards Points are not valid unless earned in strict compliance with the requirements set forth and intended by RAW, and member shall not attempt to earn points by any means (including without limitation, by using any script, bot, data mine or other automated means) that only simulates applicable requirements. In the case of a dispute regarding the Rewards Points available to any member, RAW’s decision will be final. Upon termination of membership for any reason, all Rewards Points will be forfeited.

By enrolling in the Rewards Program, you irrevocably agree not to:
(a) take any action; or
(b) upload, post, submit or otherwise distribute or facilitate distribution of any text, communications, software, photographs, videos, sound recordings, data or other information (User Content) using any communications service, discussion forum or other feature available on or through RAW’s website, in a manner that is unlawful, deceptive, misleading, fraudulent, threatening, abusive, harassing, libelous, defamatory, discriminatory, invasive of another's privacy, tortious, obscene, profane, infringes on any patent, trademark, trade secret, copyright, right of publicity, right of privacy, any other right of any party or which otherwise violates the general terms and conditions of use of the website, privacy policy, or any other agreement.

You further agree not to:
(a) upload any content that imposes an unreasonable or disproportionately large load on RAW’s' computing, storage or communications infrastructure or attempts to gain unauthorized access to the Service, other accounts, computer systems or networks connected to the Service, through password mining or otherwise;
(b) contains software, viruses or any other computer codes, files or programs that are designed or intended to disrupt, damage, limit or interfere with the proper function of any software, hardware or network system or to damage or obtain unauthorized access to any system, data or other information of RAW or any third party;
(c) create or purport to create Reward Program member accounts by any automated means or under false pretenses or impersonates any person or entity, including an employee or representative of RAW or its affiliates;
(d) harvests, scrapes or collects any information from www.rawsugarliving.com

RAW is not responsible for requests, rewards (including RAW products as part of rewards) or correspondence lost or delayed in the mail or not received by email. Where a reward is provided by a third party, RAW  is not responsible for the goods and/or services that such third parties may provide.

RAW, its affiliates and their respective officers, directors, employees, and agents (Released Parties) make no warranty, whether express or implied, in relation to the Rewards Program, including, but not limited to, any warranties of merchantability or fitness for a particular purpose with respect to RAW products, merchandise, the website https://rawsugarliving.com or membership of the Rewards Program. By participating in the Rewards Program, each member hereby forever indemnifies and releases the Released Parties from and against any and all claims, damages, losses, liabilities and expenses (including, without limitation, attorney's fees) relating to that member's participation in the Rewards Program.

RAW is not responsible for problems related to any of the equipment or programming associated with or utilized by the member, any human error, any interruption, deletion, omission, defect or failure of any network or electronic transmission for whatever reason.

The Rewards Program and these Rewards Terms are not intended to derogate from the general terms and conditions of the use of the website https://rawsugarliving.com or Terms and Conditions of sale of RAW products and will be governed by and construed under the substantive laws of New York, without reference to conflict–of–laws considerations. Without limiting the discretions afforded to RAW in relation to these Rewards Terms, RAW and each member agree that any dispute, claim, or controversy arising from or relating to the Rewards Program, or these Rewards Terms will be resolved by binding arbitration conducted in the State of New York, RAW and each member acknowledge and agree that each has chosen arbitration rather than litigation to resolve any such dispute, claim or controversy. RAW and each member understand that a judgment on any arbitral award may be entered in any court having jurisdiction.
